3. Platform Description

Pomp is a decentralized platform that allows users to create and trade tokens on the Solana blockchain. The Platform uses a bonding curve mechanism for token pricing. Users can create tokens by paying a deployment fee and trade tokens through the Platform's interface.

4. Risks

Trading cryptocurrency and tokens involves substantial risk of loss. You acknowledge and agree that:

• Token prices can be highly volatile and may result in significant losses
• Past performance is not indicative of future results
• You are solely responsible for your trading decisions
• You should only trade with funds you can afford to lose
• The Platform does not provide financial advice

5. User Responsibilities

You agree to:

• Provide accurate information when using the Platform
• Maintain the security of your wallet and private keys
• Not use the Platform for any illegal or unauthorized purpose
• Not attempt to manipulate token prices or engage in market manipulation
• Comply with all applicable laws and regulations in your jurisdiction

6. Token Creation

When creating a token on Pomp, you acknowledge that:

• A deployment fee is required to create a token
• All tokens are created as fair-launches with no presale or team allocation
• You are responsible for the content and branding of tokens you create
• The Platform reserves the right to remove tokens that violate these Terms

7. Fees

The Platform charges fees for certain services, including token creation and trading. All fees are non-refundable. Fee amounts may be updated from time to time.

8. Intellectual Property

The Platform and its original content, features, and functionality are owned by Pomp and are protected by international copyright, trademark, and other intellectual property laws.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

IN NO EVENT SHALL POMP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE PLATFORM.

11. Indemnification

You agree to indemnify and hold harmless Pomp and its affiliates from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Platform constitutes acceptance of the modified Terms.
